You can decide to stop the mutual divorce process at any time before the final hearing in court. However, the refundability of the fees you have paid depends on which stage you are at. According to our detailed Cancellation and Refund Policy , here is how it works for our standard mutual divorce case fees (for Resident Indians):
- 1st Payment (₹1,000 – Divorce Application): Non-refundable. This fee covers the services already provided, which include processing your application and initiating the formal email communication with both spouses to seek their consent.
- 2nd Payment (₹9,000 – Divorce Petition): Non-refundable.
- 3rd Payment (₹15,000 – First Motion) & 4th Payment (₹20,000 – Second Motion): A partial refund may be possible under specific conditions.
- If you do not schedule any hearing after making the 3rd or 4th payment, and you request a refund by emailing help@mutualdivorcelawyer.co.in within 30 days of making that payment, you will be eligible for a refund of ₹10,000.
- No refund is processed if you cancel a scheduled hearing or if you do not request a refund within the 30-day window.
For NRI Clients: A similar principle applies with different amounts. The 1st (₹1,000) and 2nd (₹9,000) payments are non-refundable. For the 3rd or 4th payment of ₹25,000 each, a partial refund of ₹12,500 is possible under the same conditions (no hearing scheduled and refund requested within 30 days).
