Mutual divorce — also called divorce by mutual consent — is the most peaceful and legally efficient way for married couples in Delhi to end their marriage when both agree to separate. Under Section 13B of the Hindu Marriage Act, 1955, a joint petition can be filed in the Delhi Family Court once both spouses have mutually decided to dissolve their marriage.
In this joint petition, the couple sets out all agreed terms regarding child custody, alimony or maintenance, and division of property or assets. Who Can File for Mutual Divorce in Delhi?
You can file for a Mutual Consent Divorce in Delhi if the following conditions are met:
Mutual agreement: Both husband and wife voluntarily agree to end the marriage.
One-year separation: The couple has been living separately for at least one year.
Settlement terms: Both have reached a written agreement on all key issues such as child custody, financial support, and asset division.
No disputes: There are no ongoing allegations, criminal cases, or contested claims between the spouses.
Meeting these legal requirements ensures the court can grant a decree of divorce under Section 13B.
7-Step Process of Mutual Divorce in Delhi Family Courts

Step 1: Apply for Divorce Online | Fee: ₹1,000
One spouse fills out our Mutual Divorce Online Form and pays the ₹1,000 fee. This initiates a confidential email conversation with both parties. We first advise careful reconsideration. If both remain firm, we guide them to discuss mutual settlement terms.

Step 2: Settlement Terms | Documents
Both parties provide the finalized, mutually agreed-upon terms (child custody, maintenance, property division) and all necessary documents (address proof, marriage proof, etc.) via email.

Step 3: Draft Mutual Divorce Petition | Fee: ₹9,000
Delhi has six Family courts: Dwarka, Saket, Patiala House, Rohini, Tis Hazari and Karkardooma. For NRIs, a Special Power of Attorney (SPA) document also needs to be drafted. The appropriate court for filing your case is determined based on the address listed in your documents. We finalize your joint mutual divorce petition and all supporting affidavits, ensuring all mutually agreed terms are accurately incorporated and the necessary documents are properly attached.

Step 4: First Motion Hearing in Court | Fee: ₹15,000 (₹25,000 for NRIs)
Both parties will need to visit the Family Court to sign the first motion petition. If either party is located outside Delhi, we can arrange for the petition to be mailed to them for signing. Once signed, we will file your case with the court. A few days after filing, the case will be listed for the first motion hearing. At this hearing, the husband and wife must visit the court. For NRI clients, their SPA must be physically present in court, while the NRI client themselves must appear via video conference.

Step 5: Cooling off Period/Waiver
After the first motion, the court directs the couple to observe a six-month cooling-off period. If the parties wish to proceed sooner, they may, after one week from the date of the first motion, jointly file the second motion petition along with an application to waive this waiting period. The Honorable Judge will then decide whether to grant the waiver.

Step 6: Second Motion Hearing in Court | Fee: ₹20,000 (₹25,000 for NRIs)
Both parties are required to sign the second motion petition. If either party is located outside Delhi, we can arrange for the petition to be mailed to them for signing. Once the signed petition is returned, we will file it with the court. A few days after filing, the case will be listed for the second motion hearing. The husband and wife must visit the court. For NRI clients, their SPA must be physically present in court, while the NRI client themselves must appear via video conference.

Step 7: Divorce Decree from Court
Shortly after the second motion hearing, the Family Court issues two certified divorce decrees—one for the husband and one for the wife. We promptly mail these to both parties upon receipt from the court. Alternatively, the parties may collect the decrees directly from our office.

While the initial stages (filling the form, receiving documents, and consultations) can be managed online, the final legal steps require physical presence or formal procedures:
- Signing Documents:
Both spouses must physically sign the first and second motion papers. If either party is outside Delhi, we can mail the documents for signing. The signed papers must then be notarized locally and the originals mailed back to us for court submission. - Court Appearances:
Physical presence is mandatory for court hearings in Delhi. The city has six family courts (Dwarka, Saket, Patiala House, Rohini, Tis Hazari and Karkardooma), and your case is filed based on the address on your documents. - Exceptions for NRIs/Non-Residents:

To establish jurisdiction and file your case in Delhi, you must meet one of two criteria:
- Provide a valid Delhi address proof (like Aadhaar Card, Passport, Driving License or Voter ID) in the name of either the husband or wife, or
- Provide proof that your marriage was solemnized in Delhi.
A rent agreement is generally not accepted as valid address proof by the Delhi family courts.
Additionally, you must submit an original marriage proof, which can be:
- Marriage Certificate
- Wedding Invitation Card
- A certificate issued by the religious institution where the marriage was solemnized
The mutual divorce process in Delhi follows a structured 7-step approach:

For a mutual divorce in Delhi, both spouses typically need to visit the court four times:
- First Motion Signing: To physically sign the joint petition at the court.
- First Motion Hearing: To appear before the judge to record your initial statements and consent.
- Second Motion Signing: To sign the second motion petition at the court.
- Second Motion Hearing: To reappear before the judge to reaffirm your mutual consent and obtain the final divorce decree.
Please note: Court schedules can be unpredictable. Occasionally, hearings may be postponed due to judicial leave, administrative delays, or incomplete paperwork, which could require additional visits. Note: If either spouse is outside Delhi, documents can be mailed for signing (after notarization), but physical presence is mandatory for hearings unless the court grants an exemption for virtual appearance, which is rare and subject to the judge’s discretion.
The timeline varies. If the court allows a waiver of the 6-month waiting period, the process can be completed in 1-2 month . Without the waiver, it typically takes 6-7 months. Timelines depend on factors like court schedules and your cooperation.
You can complete the mutual divorce process even if you live outside Delhi or abroad. Here’s how we facilitate it:
