    Yes, we need confirmation from both spouses. Mutual divorce is based on the mutual consent of both parties. We require confirmation from both husband and wife before we can proceed with the legal process. This is why we email both spouses and ask each to reply with “Yes” to confirm their agreement.

    Is there a time limit?
    There is no strict time limit to provide confirmation. However, please note that the subsequent fees will be charged based on the prevailing rates at the time you proceed. Fee structures are subject to revision, and the current rates may not remain the same indefinitely.

    We recommend responding at your earliest convenience to lock in the current fee structure and avoid any future changes.

    If your spouse does not reply with “Yes” or explicitly refuses consent, we cannot proceed with the mutual divorce process. Mutual divorce requires agreement from both parties.

    We do not send follow-up emails, as it may be perceived as harassment or pressure. Divorce is a sensitive personal matter, and we respect your spouse’s choice not to respond.

    Important Notes:

    • If your spouse refuses consent, you will need to consult another law firm that handles contested divorce cases.
    • The ₹1,000 fee is non-refundable, as it covers the service of drafting and sending the formal email to your spouse, which has already been completed.

    You can decide to stop the mutual divorce process at any time before the final hearing in court. However, the refundability of the fees you have paid depends on which stage you are at. According to our detailed Cancellation and Refund Policy , here is how it works for our standard mutual divorce case fees (for Resident Indians):

    • 1st Payment (₹1,000 – Divorce Application): Non-refundable. This fee covers the services already provided, which include processing your application and initiating the formal email communication with both spouses to seek their consent.
    • 2nd Payment (₹9,000 – Divorce Petition): Non-refundable.
    • 3rd Payment (₹15,000 – First Motion) & 4th Payment (₹20,000 – Second Motion): A partial refund may be possible under specific conditions.
      • If you do not schedule any hearing after making the 3rd or 4th payment, and you request a refund by emailing help@mutualdivorcelawyer.co.in within 30 days of making that payment, you will be eligible for a refund of ₹10,000.
      • No refund is processed if you cancel a scheduled hearing or if you do not request a refund within the 30-day window.

    For NRI Clients: A similar principle applies with different amounts. The 1st (₹1,000) and 2nd (₹9,000) payments are non-refundable. For the 3rd or 4th payment of ₹25,000 each, a partial refund of ₹12,500 is possible under the same conditions (no hearing scheduled and refund requested within 30 days).

    For Resident Indians:

    • Total Fee: ₹45,000 (covers both parties in court)
    • Payable in 4 installments:
      • 1st Payment: ₹1,000 – Divorce Application
      • 2nd Payment: ₹9,000 – Divorce Petition
      • 3rd Payment: ₹15,000 – First Motion
      • 4th Payment: ₹20,000 – Second Motion

    For NRIs:

    • Total Fee: ₹60,000 (covers both parties in court)

    The entire process of mutual divorce cannot be completed online. Both spouses are required to physically sign the Mutual Divorce Petition and appear before the Family Court for hearings.
